Terms & Conditions

  2. The Win a Fonz Moto electric scooter this Earth Hour’ Competition Giveaway (“Promotion”) commences on 02/03/2021 at 10.00 am AEST and final entries close at 11.59 pm AEST on 31/03/2021 (“Promotional Period”). The Licence No. for this Promotion is TBC

  3. Information on how to enter this Promotion and the prize form part of these Terms and Conditions. 

  4. By participating in this Promotion the entrant (“Entrant”) is deemed to have accepted these Terms and Conditions. 

  5. Entry is only open to Australian residents aged 18 years or over. 

  6. The Promoter is the World Wide Fund for Nature Australia (WWF-Australia - ABN 57 001 594 074) of Level 1, 1 Smail Street, Ultimo, NSW 2007 (“WWF-Australia” or “Promoter”). The Promotion is conducted by the Promoter with the support of its partner, Fonz Moto ABN 69 146 454 113 (“Partner”). 

  7. The Promoter and Partner directors and employees and their immediate families and its Partner are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 

  8. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties including agents, contractors, service providers, Promotion suppliers and to Australian regulatory authorities. Validity of an entry is conditional on providing this personal information. Any personal information provided will be held in accordance with WWF-Australia’s Privacy Policy which can be accessed at http://www.wwf.org.au/privacy-policy#gs.GCOE8QA  

  9. To enter the Promotion, Entrants must undertake the following steps during the Promotional Period: 

    1. Visit www.earthhour.org.au/ and sign up for Earth Hour by inputting the requested information including full name and email address; and 

    2. Complete and submit the Win a Fonz Moto electric scooter this Earth Hour Competition Giveaway entry form online. 

Incomplete or indecipherable entries will be deemed invalid. 

  1. Only one (1) entry is permitted per person.

  2. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant. 

  3. The winner will be drawn on Tuesday, 13 April 2021 at 10AM Sydney time at Level 1, 1 Smail Street, Ultimo, Sydney, NSW 2007. 

  4. The prize will be ONE Fonz Moto scooter; a Fonz Moto “Arthur” scooter (to the value of $4,580). The maximum value of the Entrant’s prize is $4,580. This cannot be taken as cash.

  5. The prize is supplied and will be delivered by the Supplier, Fonz Moto Australia Pty Ltd (ABN 69 146 454 113).

  6. The prize will be delivered by the Supplier to the Australian capital city closest to the winner’s residence. It will be the responsibility of the winner to collect the scooter.

  7. The Supplier reserves the right to replace the prize with an alternative prize of equal value if circumstances beyond the Supplier’s control make it necessary to do so. The Promoter will not be responsible for any changes to the prize that are made by the Supplier. 

  8. The Promoter’s decision is final as to the winner, and no correspondence will be entered into. 

  9. The winner must have a valid licence, and must wear protective gear, in order to legally drive the prize within Australia. Licencing requirements vary between state/territory jurisdictions. It is the sole responsibility of the winner to understand the requirements to legally and safely drive the prize.

  10. The Promoter is not liable for any vehicle related expenses associated with the prize including licencing, insurance, helmets and other protective gear. The Promoter is not liable for transport or any other incidental or additional costs or expenses. 

  11. The Promoter and the supplier are not liable for any death or personal injury, medical expenses, loss of income or any other expenses whatsoever caused by, arising from or associated with use of the prize. 

  12. The winner will be notified at or before 5.30pm Sydney time on Friday 16 April 2021 by the Promoter sending a winner notification email to the email address in clause 9(a) of these Terms and Conditions (“Winner Notification Email”). The winner’s first name and last initial will be published on the WWF-Australia Earth Hour website at www.earthhour.org.au/get-involved/win, and will remain on the website for a minimum of 90 days.  

  13. The winner must claim the prize by replying to the Winner Notification Email within 90 days of the date the Promoter transmits the Winner Notification Email to the clause 9(a) address. The winner must provide all details reasonably required by the Promoter and the Supplier to facilitate taking possession of the prize. 

  14. If the winner does not claim the prize in accordance with clause 22, the prize will be deemed unclaimed and it will be redrawn on Monday, 19 July 2021 at 10AM Sydney time at Level 1, 1 Smail Street, Ultimo, Sydney, NSW 2007. The winner of the redraw will be notified by 5.30pm Sydney time on Tuesday, 20 July 2021 by the Promoter sending a redraw Winner Notification Email to the email address in clause 9(a). The redraw winner’s first name and last initial will be published on the WWF-Australia Earth Hour website at www.earthhour.org.au/get-involved/win, and will remain on the website for a minimum of 90 days. 

  15. The redraw winner must claim the prize by replying to the Winner Notification Email within 90 days of the date the Promoter transmits the Winner Notification Email to the clause 9(a) address. The redraw winner must provide all details reasonably required by the Promoter and the Supplier to facilitate taking possession of the prize. 

  16. If the redraw winner does not claim the prize in accordance with clause 24, the prize will be deemed unclaimed and it will be further redrawn on Thursday, 19 October 2021 at 10AM Sydney time at Level 1, 1 Smail Street, Ultimo, Sydney, NSW 2007. The winner of the further redraw will be notified by 5.30pm Sydney time on Friday, 20 October 2021 by the Promoter sending a redraw Winner Notification Email to the email address in clause 9(a). The further redraw winner’s first name and last initial will be published on the WWF-Australia Earth Hour website at www.earthhour.org.au/get-involved/win, and will remain on the website for a minimum of 90 days. 

  17. The further redraw winner must claim the prize by replying to the Winner Notification Email within 90 days of the date the Promoter transmits the Winner Notification Email to the clause 9(a) address.The further redraw winner must provide all details reasonably required by the Promoter and the Supplier to facilitate taking possession of the prize. 

  18. If the further redraw winner does not claim the prize in accordance with clause 26, the prize will be deemed unclaimed and it will be further redrawn on Monday, 24 January 2022 at 10AM Sydney time at Level 1, 1 Smail Street, Ultimo, Sydney, NSW 2007, and the process identified in clauses 23 and 24 (with appropriate changes of date) followed. If there is no response to the redraw in this clause, the process will continue until the prize is awarded. 

  19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including the fact that the winner was successful), and promoting any products manufactured, distributed and/or supplied by the Promoter and the Supplier, and the mission and activities of the Promoter. 

  20. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the Entrant’s personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. 

  21. WWF-Australia may withdraw this Promotion, vary the prize or otherwise amend these Terms and Conditions at any time. Without limitation to the foregoing, if the prize becomes unavailable, including because of delays associated with identifying the winner, the Promoter may substitute the prize with a prize of equal value. 

  22. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

  23. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: 

    1. to disqualify any Entrant; or

    2. to modify, suspend, terminate or cancel the Promotion. 

  24. Any cost associated with accessing the Promoter's website for the purpose of entering this Promotion is the Entrant's responsibility and is dependent on the internet service provider used. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Promotion. 

  25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth) or any other non-excludable implied warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). 

  26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to: 

    1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 

    2. Any theft, unauthorised access or third-party interference; 

    3. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; 

    4. Any variation in prize value to that stated in these Terms and Conditions;  

    5. Any tax liability incurred by a winner or entrant; or 

    6. Taking and/or use of the prize. 

    7. As a condition of accepting the prize, the winner must provide personal information, and sign any legal documentation as and in the form required by the Promoter and/or the Supplier in their absolute discretion, including but not limited to a legal release and indemnity form. 

  27. This agreement is governed by the law in force in the State of New South Wales, Australia. Any dispute arising in connection with these Terms and Conditions or in connection with the Promoter which cannot be resolved by good faith negotiations between the Entrant and the Promoter may be referred to mediation or to arbitration. However, the Promoter reserves, at its absolute discretion, the right to instigate legal proceedings prior to negotiation, arbitration or mediation against any individual, organisation or entity, who in the Promoter’s opinion has acted in breach of these Terms and Conditions.
